Welcome to ENIGMA (“we,” “our,” “us”), an AI-driven visual design and 3D content agency headquartered in India. By accessing or using our website, services, or deliverables (collectively, the “Services”), you agree to these Terms & Conditions (“Terms”). If you do not agree, discontinue use immediately.
 
1. Scope of Services
ENIGMA provides AI-generated, 3D-rendered, and motion-graphic visual content for commercial, branding, artistic, and experiential purposes, including but not limited to:

  • Creative concept development and brand visual strategy

  • 3D modeling, rendering, and animation

  • AI-driven advertising and campaign asset creation

  • Visual content systems for long-term brand usage

  • Immersive and gallery-ready art visuals

We may update or modify our Services without prior notice.
 
2. Intellectual Property (IP) Rights (Copyright Act, 1957 & Designs Act, 2000)

  • Ownership: Unless agreed otherwise in writing, ENIGMA retains full copyright, design rights, and moral rights over all concepts, drafts, renderings, animations, AI-generated outputs, and proprietary creative workflows.

  • License to Client: Upon full payment, the Client is granted a limited, non-exclusive, non-transferable license to use final deliverables strictly within the agreed project scope.

  • Restrictions: Clients may not alter, reverse-engineer, resell, sublicense, or use deliverables in any unlawful or defamatory manner.

  • AI-Specific Clause: While ENIGMA uses proprietary AI workflows and curated datasets, absolute uniqueness cannot be guaranteed.
     

3. Client Materials
The Client warrants that all materials provided:

  • Are owned by the Client or legally licensed for use.

  • Do not infringe third-party rights under Indian IP laws.

The Client indemnifies ENIGMA against any claims arising from the use of such materials.
 
4. Confidentiality
All project-related information, pricing, and proprietary methods are strictly confidential and may only be disclosed if:

  • Required by Indian law or court order.

  • Written consent is given by the disclosing party.
     

5. Payments & Refunds

  • All fees are payable in Indian Rupees (INR) as per the agreed quotation or proposal, unless specified otherwise.

  • Work commences only upon receipt of the stipulated advance payment.

  • No refunds will be issued once work has begun, as per industry practice for bespoke creative services.
     

6. Delivery & Revisions

  • Delivery timelines will be specified in writing at project commencement.

  • Revisions beyond the agreed number will be charged at additional rates.
     

7. Limitation of Liability (Indian Contract Act, 1872)
Our total liability will not exceed the total project fee paid. ENIGMA shall not be liable for:

  • Loss of business opportunities or profits.

  • Delays caused by factors beyond our control (including force majeure events).
     

8. Governing Law & Jurisdiction
These Terms are governed by the laws of India. All disputes are subject to the exclusive jurisdiction of the courts in New Delhi, India.

This Privacy Policy is compliant with the Information Technology Act, 2000 (as amended) and the Digital Personal Data Protection Act, 2023.
